Report against forgery and nonlegislative work of the Zvezdara municipality with respect to the illegal housing building

  1. Building permits for construction above the roof of the existing buildings in Konjarnik were, among others, given to Housing Cooperative "Prima Stan" Belgrade in 1994. In that moment, nevertheless, Housing Cooperative "Prima Stan" was not registered with the Commercial Court, only Joint Stock Company "Prima Stan" Belgrade by the court decision from 31 December 1993. In other words, Housing Cooperative "Prima Stan", as joint stock company, tried to transform the joint capital into private one and performed transformation of the organization, from cooperative to the joint stock company. Regardless of that, the Agency for the capital value estimation issued their decision number 1434/92 from 6 June 1996, annulling the attempt of the Housing Cooperative "Prima Stan" to transform the cooperative capital to the private one. After the failure of their attempt, the company moves its head office to Senta, and with the Commerce Court in Subotica registers the company "Housing Cooperative Prima Stan" Senta, Beogradska 1 street, which means that the Housing Cooperative "Prima Stan" Belgrade, does not exist since 31 December 1993.
  2. According to this, decisions issued by the Zvezdara Municipality in 1994, and made out to Housing Cooperative "Prima Stan" Belgrade are made out to non existent person.
  3. On 30 August 2002, Zvezdara Municipality issued the decision on building permits issue for the second time and stipulated, hence with, that the Housing Cooperative "Prima Stan" Belgrade (without the address, although the address is a mandatory part of a company), submitted the request for approval of construction works. This quote is a forged one, for the Housing Cooperative "Prima Stan" Belgrade could not submit a request for approval of construction work, because the company is not registered with the Commerce Court in Belgrade (which means that they do not have the seal to verify the request).
  4. Zvezdara Municipality could not allow construction works to Housing Cooperative "Prima Stan" Belgrade, because there are no such housing cooperatives registered with Commerce Court in Belgrade.
  5. Building company "HB Prima Stan" Belgrade, Francuska 67 Street is not registered with the Commerce Court in Belgrade.
  6. According to this, and whereas from 1993, the Housing Cooperative "Prima Stan"
    Belgrade, does not exist, all decisions from the Zvezdara Municipality from 1994 are legally void, because they are made out to a non existing legal person.
  7. Building company "HB Prima Stan" Belgrade, Francuska 67 street is not a legal inheritor of the Housing Cooperative "Prima Stan" Belgrade, Cara Dusana 72 street, for the housing building is owned by the cooperative members, and can not be transformed to socially or privately owned property(the Agency has annulled capital transformation from cooperative to social, i.e. private). Legal continuity must come out the court's register. In this case, the Municipality had to ask for evidence from the register stating that the building company "HB Prima Stan", Limited Liability Company represents a legal inheritor of the Housing Cooperative "Prima Stan", which, in 1994, received a building permit.
  8. Zvezdara Municipality forges the name of the building company "HB Prima Stan" LLT, Belgrade, to find the connection between the housing cooperative and company, for it has to conceal the fact that they were giving the construction above the roof of the existing buildings to the building company without any grounds, and contrary to the prevailing regulations.
  9. Bearing in mind that we feel that this may be the case of possible corruption, we think that it is necessary to perform the supervision of the relevant agencies.
