Institutional obstacles for the fight against corruption
Conclusions
Eight years have past since the citizens demanded democratic reforms on the elections, and in fighting for maintenance of the election results as well. In the meantime, it became clear that the corruption is the greatest obstacle for essential democratic reforms. Of course, noticing the problem is not such a great result for such a long period, but it could be a framework for searching for solutions and it might be also a good start for commencing the fight against corruption and building of democratic institutions as well. The expiriences assure us that the searching for solutions must not be stopped and that the worst thing for our country is to give up the results which have been attained so far.
On Saturday 31st of May 2008. in the press center of the Government of the Republic of Serbia the Anti-Corruption Council of the Republic of Serbia, the Association of Misdemeanor Judges of the Republic of Serbia, the Prosecutor Association of Serbia and Judges' Association of Serbia organized a round table Institutional obstacles for the fight against corruption with the following conclusions:
- The discussion on institutional obstacles for the fight against corruption, which has commenced today, should be continued through thematic round tables. The following issues have been suggested:
- Constitutional solutions which disable the independence of judiciary, first of all the prosecutors, making the obstacles for efficient combat against corruption;
- Immediate implementation of the new Misdemeanor Act, which would establish the permanence of function of misdemeanor judges and reduce the influence of the government both on their election and decisions;
- The problem of the fight against corruption regarding the application of the National Strategy For the Fight Against Corruption: addopting laws on fight against corruption and analysis of the draft of Law on Agency for the fight against corruption;
- Dispossesion of assets acquired by illegal acts;
- Privatization;
- Public Procurement;
- Financing of political parties.
We shall try to include as many institutions as possible through organization of thematic round tables, especially those whose task is detecting offenders and sanctioning the corruption offences. The participants of round table are obliged to deliver suggestions for the schedule of thematic discussions, which are to be organized after summer holidays.
- The Anti-Corruption Council of the Republic of Serbia, the Association of Misdemeanor Judges of the Republic of Serbia, the Prosecutor Association of Serbia and Judges' Association of Serbia will be coordinating the organization of round tables. Besides participating of the state institutions representatives, these round tables will also be open for the public.
- The Council and the professional associations will commence drafting a law which addopting is necessary for combating corruption. We shall also recommend some changes of existing regulations in order to improve the fight against corruption.
- The organizers of the round table will contact RTS during next week with a proposal for organizing a discussion with institutions which have participated in round table activities on the subject Institutional obstacles for the fight against corruption.
